La declaraci\u00f3n se produjo tras la derogaci\u00f3n de la medida por el Senae, lo que encendi\u00f3 alertas en el sector jur\u00eddico. Para el exministro Daniel Legarda, la postura contradice la normativa andina: cuando una medida es declarada ilegal, los recursos deben ser devueltos. Francisco Ball\u00e9n, otro exministro, afirma que la devoluci\u00f3n es inevitable y que el anuncio oficial busca desanimar a los importadores.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El origen del conflicto est\u00e1 en la Resoluci\u00f3n N\u00b0 2582 de la Comunidad Andina (CAN), que declar\u00f3 ilegal la tasa desde su implementaci\u00f3n. El art\u00edculo 122 del C\u00f3digo Tributario ecuatoriano respalda la devoluci\u00f3n por pago indebido. Existen precedentes: en 2017, una tasa similar tambi\u00e9n fue anulada y varios importadores lograron recuperar sus dineros tras procesos judiciales. Los afectados deben presentar un reclamo de pago indebido ante la aduana. Si es negado, pueden acudir al Tribunal Distrital de lo Contencioso Tributario.
